Welcome to XDown! These Terms govern your access to and use of our mobile application.

These Terms of Service ("Terms") govern your access to and use of the XDown mobile application (the "App"), provided by Logickos ("we", "us", or "our").

1. Description of Service

XDown is a mobile application that allows users to:

• Extract and download publicly available videos and images from X/Twitter posts
• View and manage downloaded media files
• Play downloaded videos and view images within the App

The App is provided "as is" and "as available" without warranties of any kind.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

3. License and Restrictions

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

3.2 Restrictions

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Download content that you do not have the right to download
• Violate any intellectual property rights of X/Twitter or content creators
• Use the App to download copyrighted content without permission
• Modify, reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or proprietary notices from the App
• Use the App in any way that could damage, disable, or impair our servers
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scrapers) to access the App
• Resell, redistribute, or sublicense the App

4. Content and Intellectual Property

4.1 Third-Party Content

The App allows you to download content from X/Twitter. You acknowledge that:

• All downloaded content belongs to its respective owners
• You are responsible for ensuring you have the right to download and use such content
• We do not claim ownership of any content you download
• You must respect copyright laws and the rights of content creators
• Downloaded content should only be used for personal, non-commercial purposes

4.2 Our Intellectual Property

The App, including its design, features, functionality, and all related intellectual property rights, is owned by Logickos. You may not use our trademarks, logos, or branding without our prior written consent.

5. User Responsibilities

You are responsible for:

• Maintaining the security of your device
• All activity that occurs through your use of the App
• Ensuring your use complies with applicable laws
• Respecting the intellectual property rights of others
• Using the App in accordance with X/Twitter's Terms of Service
• Any content you download and how you use it
• Managing storage space on your device

6. Advertising

The App displays advertisements provided by Google AdMob. By using the App, you agree that:

• Advertisements may be displayed within the App
• We may use third-party advertising partners
• Advertisers may collect information as described in our Privacy Policy
• You will not interfere with or block advertisements
• You will not click on ads fraudulently or encourage others to do so

7. Disclaimers and Limitations of Liability

7.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of content
• Warranties that defects will be corrected

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Unauthorized access to your device or data
• Any content downloaded through the App
• Actions of third parties
• Any damages exceeding $50 USD

7.3 Indemnification

You agree to indemnify, defend, and hold harmless Logickos and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws
• Content you download or use

8. Termination

8.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

8.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the App or its features
• At our sole discretion

8.3 Effect of Termination

Upon termination:

• Your license to use the App will immediately cease
• You must uninstall the App from your device
• Provisions that should survive termination will remain in effect

9. Updates and Modifications

9.1 App Updates

We may release updates, upgrades, or new versions of the App. You may need to update the App to continue using it. Updates may be automatic or require manual installation.

9.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Providing in-app notifications

Your continued use of the App after changes constitutes acceptance of the modified Terms.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

10.2 Arbitration

Any dispute arising from these Terms or the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.

10.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
